Independant Non-Funded Intervenor Asks For Disciplinary Measure Against Enbridge Vice-President

Smithers, BC, February 4, 20123 – Dr. Josette Wier is asking the JRP to take applicable disciplinary measures against Mr. Ken MacDonald, Vice-President of Law and Regulatory, Northern Gateway, for submitting an incomplete description of documents in his December 28, 2012, letter introducing new information related to Route Revision V.

After Dr. Wier, an independent intervenor in the hearing process, who has received no funding of any sort, complained about the  significant embedded proposed changes unrelated to the route revision, the JRP ordered the company to produce a chart showing which proposed changes are related to the route revision, which are corollary and which are unrelated.  The company released the document by the due date of February 1, confirming 11 changes completely unrelated to the route revision.  Most noticeable is the considerable increase of the oil tank farm in Kitimat with an almost doubled capacity.  

 She says Mr. MacDonald, has no excuse for hiding such changes to the Panel which has the legal power of a tribunal: “Not only is he a lawyer himself, he has enormous resources at his disposition including a large legal team and all the money he can ask.  There is no room for error at his level”.

 She further questions Mr. MacDonald's adherence with Enbridge's own Corporate and Social Responsibility Code which requires employees like Mr. MacDonald “to build on [Enbridge's] foundation of operating excellence by adhering to a strong set of core values”.  Further the Code requires “ Enbridge employees [to] demonstrate Integrity, Safety and Respect

 In her Notice of Motion to the JRP filed today, Dr. Wier notes that the Panel took extraordinary measures to ensure a respectful unfolding of the Hearings held in Victoria, Vancouver and Kelowna.  She asks the Panel to do the same concerning Mr. MacDonald, including the possibility of barring him from any further submission to the Panel.
